New hire reporting is a requirement under the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA). Employers must report newly hired and rehired employees to their state's Directory of New Hires, which helps locate parents who owe child support.
All new hires must be reported, including full-time, part-time, and temporary employees. Rehired employees must also be reported. Some states also require reporting of independent contractors.
Federal penalties include $25 per late report, or up to $500 if there's a conspiracy between the employer and employee to not file or provide false information. State penalties may vary.
Multi-state employers can either report to each state where they have employees, or designate one state for centralized reporting. If reporting to one state, you must register with the federal Office of Child Support Enforcement.
