Oregon has strict final pay requirements. Penalties for late final paychecks: Employee's wages continue at their regular rate (up to 8 hours/day) for up to 30 days until paid. This penalty can be significant. Accrued, unused vacation must be paid out if employer policy provides for it.
If your handbook or policy states that vacation is earned and accrued, it becomes a wage obligation upon separation. Use-it-or-lose-it policies are generally invalid for accrued vacation. Employers can cap accrual but cannot forfeit already-accrued time.
